These Terms of Service (“Terms”) govern your access to and use of kazzy.shop (the “Site”) and your purchase or use of products and services offered through the Site.
The Site is operated under the Kazzy brand. Throughout these Terms, “Kazzy,” “we,” “us,” and “our” refer to the operator of the Site and seller of the products offered through it.
By accessing the Site, placing an order, creating an account, subscribing to marketing communications, or otherwise using our services, you agree to be bound by these Terms, together with any policies referenced in them, including our Privacy Policy, Refund & Return Policy, and Shipping Policy.
If you do not agree to these Terms, please do not use the Site or purchase products through it.
1. Online Store Terms
You may use the Site only for lawful purposes and in accordance with these Terms.
By using the Site, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have permission from a parent or legal guardian where required.
You may not use our products, Site, or services for any illegal or unauthorized purpose.
You may not attempt to:
- Interfere with the operation or security of the Site
- Introduce viruses, malware, or malicious code
- Circumvent security or access controls
- Scrape or collect information from the Site in an unauthorized manner
- Impersonate another person
- Submit false or misleading information
- Use the Site in violation of applicable law
We may suspend or terminate access to the Site where reasonably necessary to protect our business, customers, systems, or legal rights.
2. Shopify Platform
Our online store is hosted by Shopify.
Shopify provides the ecommerce platform and technology used to operate the Site, process checkouts, manage orders, and support certain account, payment, and storefront functionality.
Your use of certain Shopify-powered features may also be subject to Shopify’s applicable terms and privacy policies.
3. Products and Product Information
We make reasonable efforts to display product descriptions, photographs, colors, sizing information, materials, specifications, features, and prices accurately.
However:
- Colors may appear differently depending on your screen or device.
- Product photographs may show samples or production units that vary slightly from final production.
- Minor variations in fabric texture, color, measurements, stitching, placement, or finishing may occur as part of normal manufacturing tolerances.
- Measurements shown in size guides are approximate unless otherwise stated.
We may update product information, pricing, specifications, availability, or descriptions when reasonably necessary.
Nothing in this section limits any rights relating to goods that are defective, materially misdescribed, or otherwise fail to meet applicable legal requirements.
4. Technical Product Claims
Certain Kazzy products may include technical specifications or performance characteristics such as waterproof ratings, breathability ratings, material composition, insulation weights, or similar product information.
We provide these specifications based on information supplied by manufacturers, material suppliers, product specifications, testing information, or other information reasonably available to us.
Actual product performance may depend on use, care, environmental conditions, wear, and other factors.
No product should be used in a manner inconsistent with its intended purpose.
5. Pricing
All prices are shown in the currency displayed on the Site unless otherwise stated.
Prices may change without notice before an order is placed.
Once an order has been accepted, we will not retroactively increase the price of that order except where permitted by law and necessary to correct an obvious pricing or system error.
Applicable taxes, shipping charges, duties, or other fees may be added at checkout depending on the destination and transaction.
6. Orders and Order Acceptance
Submitting an order does not necessarily mean that the order has been accepted.
We reserve the right, subject to applicable law, to refuse, limit, or cancel an order for legitimate reasons, including:
- Suspected fraud
- Payment authorization issues
- Incorrect pricing or product information
- Inventory or production limitations
- Duplicate or suspicious orders
- Orders that appear to be intended for unauthorized resale
- Technical errors
- Inability to fulfill the order
If we cancel an order after payment has been collected, we will issue the appropriate refund.
We may limit quantities available to an individual, household, payment method, shipping address, or customer where reasonably necessary.
7. Billing and Account Information
You agree to provide current, complete, and accurate information when placing an order.
You are responsible for ensuring that:
- Your billing information is accurate
- Your shipping address is complete
- Your email address is correct
- Your payment information is authorized for use
You agree to promptly update relevant account or contact information when necessary.
Kazzy is not responsible for delays or delivery problems caused by incorrect information supplied by the customer, except where otherwise required by law.
8. Winter 26/27 Preorders
Certain products may be offered on a preorder basis.
A preorder allows you to purchase a product before final production and/or fulfillment inventory is available for immediate shipment.
Products offered on preorder will be clearly identified as such.
For the Winter 26/27 collection, the estimated shipping timeframe is stated on the applicable product pages and in our Shipping Policy.
By placing a preorder, you acknowledge that:
- The product is not expected to ship immediately.
- Production and fulfillment will occur after the preorder period.
- The stated shipping timeframe is an estimate based on information reasonably available to us at the time of sale.
- Manufacturing, freight, customs, weather, carrier delays, and other circumstances may affect timing.
We maintain a reasonable basis for the shipping estimates we provide.
If we learn that we cannot ship a preorder within the timeframe represented to you, we will provide an appropriate delay notice and, where required by applicable law, allow you to accept the revised timeframe or cancel the affected unshipped order for a prompt refund. Federal Trade Commission
If we determine that we cannot fulfill a preorder, we will cancel the affected item and provide the appropriate refund.
Nothing in these Terms limits rights provided under applicable consumer-protection law.
9. Orders Containing Preorder and In-Stock Products
If an order contains both preorder merchandise and merchandise that is currently available, we may ship all items together when the preorder merchandise becomes available.
We may also choose to ship items separately.
Separate shipment is not guaranteed unless expressly stated.
Customers who require an in-stock product sooner should consider placing it in a separate order.
10. Storm Kit Bundle Promotion
Kazzy may offer promotional pricing when qualifying products are purchased together.
For the Winter 26/27 launch, a qualifying Storm 2L Jacket + Storm 2L Pant combination may receive the advertised automatic Storm Kit bundle price or discount.
Where stated, customers may mix eligible colors and sizes.
No discount code is required where the promotion is advertised as automatic.
Promotional eligibility and pricing are determined according to the offer displayed at the time of purchase.
If part of a discounted bundle is later returned, the refund may be recalculated in accordance with our Refund & Return Policy so that the retained products reflect the applicable non-bundle pricing or promotional terms.
11. Promotional Gifts
From time to time, Kazzy may offer promotional gifts with qualifying purchases.
For the Winter 26/27 launch, the first 20 qualifying orders may receive the advertised free Merino Beanie, while promotional supply lasts.
Promotional gifts:
- Are subject to availability
- Have no cash redemption value
- May not be substituted for cash
- May be subject to additional promotional terms
If a qualifying order is later returned, treatment of the promotional gift will be governed by our Refund & Return Policy and applicable law.
12. Shipping
Shipping terms, processing times, preorder timing, tracking, international shipping, and carrier-related information are governed by our Shipping Policy.
Customers are responsible for providing an accurate shipping address.
Shipping estimates are not guarantees unless expressly stated as guaranteed.
Carrier delays, customs delays, severe weather, or other events outside our direct control may affect delivery timing.
13. Returns, Exchanges, and Refunds
Returns, exchanges, refunds, customer-paid return shipping, preorder returns, bundle adjustments, and promotional gifts are governed by our Refund & Return Policy.
Unless an item is expressly identified as Final Sale before purchase, a preorder item is not automatically final sale merely because it was sold on preorder.
Nothing in these Terms limits any non-waivable consumer rights.
14. Payment
Payments may be processed through Shopify Payments or other authorized third-party payment providers.
Kazzy does not generally receive or store complete payment-card information.
Your payment provider may be subject to additional terms and privacy practices.
You represent that you are authorized to use the payment method submitted with your order.
15. Taxes, Duties, and Import Charges
Applicable sales tax may be collected where required.
For international orders, customs duties, taxes, import fees, brokerage fees, or other charges may apply depending on the destination.
Where such charges are not collected at checkout, the recipient may be responsible for them.
Kazzy does not control customs authorities or government assessments.
16. Intellectual Property
The Site and its contents, including product photography, graphics, logos, designs, text, videos, product names, branding, and other creative materials, are owned by or licensed to Kazzy unless otherwise indicated.
The Kazzy name, logo, and associated branding may be protected by trademark and other intellectual-property rights.
You may not reproduce, copy, distribute, modify, publish, display, sell, license, or commercially exploit Site content without prior written permission, except as permitted by law.
Nothing on the Site grants you ownership of Kazzy intellectual property.
17. User Content, Reviews, and Submissions
If you submit reviews, photographs, comments, feedback, messages, ideas, or other content to us, you represent that you have the right to provide that content.
You agree not to submit content that:
- Infringes another person's rights
- Is unlawful, defamatory, threatening, or fraudulent
- Contains malicious software
- Misrepresents your identity or experience
Where you voluntarily provide content for publication or reposting, you grant Kazzy a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, adapt, and distribute that content for business, marketing, and promotional purposes, subject to applicable law.
This does not transfer ownership of your original content to Kazzy.
18. Marketing Communications
If you opt in to receive promotional emails, we may send you marketing communications relating to products, launches, restocks, promotions, or other Kazzy updates.
You may unsubscribe at any time using the unsubscribe link included in marketing emails.
Unsubscribing from marketing does not prevent us from sending transactional messages relating to an order, preorder, refund, shipment, account, or customer-service request.
Our collection and use of personal information is governed by our Privacy Policy.
19. Third-Party Services and Links
The Site may contain links to or integrations with third-party websites, services, platforms, applications, or providers.
These may include payment processors, shipping carriers, analytics platforms, email providers, social networks, or other services.
We do not control third-party services and are not responsible for their content, availability, security, privacy practices, or actions.
Your use of a third-party service may be subject to that provider's own terms and policies.
20. Optional Tools and Features
We may provide access to third-party tools or features that we do not directly control.
Such tools may be provided “as available” and may be changed, discontinued, or replaced.
Your use of optional tools is at your discretion and may be governed by separate third-party terms.
21. Errors and Inaccuracies
Occasionally, information on the Site may contain typographical errors, pricing errors, inaccurate descriptions, availability errors, or other mistakes.
We reserve the right to correct errors, update information, or cancel affected orders where reasonably necessary and permitted by law.
If an order is cancelled because of such an error after payment has been collected, we will issue the appropriate refund.
22. Prohibited Uses
You may not use the Site:
- For unlawful purposes
- To violate intellectual-property rights
- To submit fraudulent or misleading information
- To harass, threaten, discriminate against, or harm others
- To distribute malware
- To conduct unauthorized scraping or data collection
- To interfere with the Site's operation or security
- To impersonate another individual or business
- To engage in fraudulent purchasing activity
- To circumvent technical protections or access restrictions
We may restrict access or take other appropriate action in response to violations.
23. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site and services are provided on an “as is” and “as available” basis.
We do not guarantee that:
- The Site will always be uninterrupted or error-free
- All information will always be completely current
- Every feature will remain available
- Third-party services will operate without interruption
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot legally be excluded.
24. Limitation of Liability
To the fullest extent permitted by applicable law, Kazzy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Site or products.
Where liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms limits liability that cannot legally be limited or excluded, including rights that may arise under applicable consumer-protection law.
25. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Kazzy from claims, liabilities, losses, damages, and reasonable expenses arising from:
- Your violation of these Terms
- Your unlawful use of the Site
- Your infringement of another person's rights
- Fraudulent or unauthorized activity conducted through your account or payment method
This section does not apply where prohibited by law.
26. Force Majeure
Kazzy will not be responsible for delays or failures caused by circumstances reasonably outside our control, including severe weather, natural disasters, carrier disruptions, labor disputes, government actions, customs delays, supply-chain interruptions, internet outages, manufacturing disruptions, or similar events.
This provision does not eliminate any refund, cancellation, or notice rights customers may have under applicable law.
27. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will remain in effect.
28. Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
29. Entire Agreement
These Terms, together with our Privacy Policy, Refund & Return Policy, Shipping Policy, and any additional terms presented at checkout or in connection with a specific promotion, constitute the agreement governing your use of the Site and purchases from Kazzy.
30. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer law provides otherwise.
Nothing in these Terms deprives a consumer of protections that cannot legally be waived under the laws applicable to that consumer.
31. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, products, services, technology, policies, or legal requirements.
The revised Terms will be posted on the Site with an updated “Last updated” date.
Changes will apply prospectively unless otherwise required by law.
